Terms of Service

These Terms of Service ("Terms") govern your access to and use of RE Microsites, including our website, dashboard, hosted property microsites, domain-related services, and related software and services (collectively, the "Service").
The Service is operated by Athencia LLC, a Washington limited liability company, dba RE Microsites ("RE Microsites," "we," "us," or "our").
By creating an account, purchasing a subscription, registering or connecting a domain, publishing a microsite, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
RE Microsites provides software that allows individual real estate agents to create, publish, and manage single-property marketing websites on custom domains.
Depending on your plan and available features, the Service may include:
- Hosted single-property microsites
- Property descriptions and listing information
- Listing photo and agent headshot storage
- Custom-domain connections
- Domain registration through RE Microsites
- Buyer lead-capture forms
- Lead management within the RE Microsites dashboard
- Transactional lead notifications
- First-party page-view analytics
- AI-assisted generation of listing headlines, bullets, and descriptions
- Related website-management and account-management functionality
We may modify, add, or remove features from time to time.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
Authentication is provided through Clerk and currently supports email and password authentication and Google OAuth.
You are responsible for:
- Providing accurate account information;
- Maintaining the security of your credentials;
- All activity occurring through your account; and
- Promptly notifying us if you suspect unauthorized access.
You may not permit unauthorized persons to access your account.
3. Real Estate Advertising Responsibilities
You are solely responsible for ensuring that your use of the Service complies with all laws, regulations, licensing requirements, brokerage policies, advertising rules, fair-housing requirements, professional obligations, and other requirements applicable to your real estate activities.
RE Microsites does not verify that:
- You are licensed to market or advertise a property;
- You are authorized by the property owner, seller, brokerage, photographer, or other rights holder to publish particular content;
- Property information is accurate, complete, or current;
- Your advertising complies with state or local real estate rules;
- Your use complies with brokerage policies; or
- Any statement you publish complies with applicable fair-housing laws.
The Service is a technology platform. RE Microsites is not a real estate brokerage, real estate agent, Multiple Listing Service, lender, title company, escrow company, property manager, or property owner.
4. Fair Housing and Non-Discrimination
You may not use the Service to create or distribute content that unlawfully discriminates against, indicates a preference regarding, discourages, excludes, or otherwise treats persons differently based on a protected characteristic under applicable federal, state, or local fair-housing or anti-discrimination law.
You are solely responsible for the legality of property descriptions, advertising copy, photographs, targeting decisions, and other content you publish.
We may remove content or suspend accounts that we reasonably believe violate applicable anti-discrimination laws or create material legal risk.
5. Your Content
"Your Content" includes property information, listing descriptions, photographs, headshots, logos, contact information, trademarks, and other materials you submit to the Service.
You retain ownership of Your Content.
You grant RE Microsites a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, resize, transmit, and display Your Content solely as reasonably necessary to provide, maintain, secure, and operate the Service.
This license does not transfer ownership of Your Content to us.
You represent and warrant that:
- You own Your Content or have all required rights and permissions to use it;
- Our use of Your Content to provide the Service does not infringe another person's rights;
- Your Content is lawful;
- Your Content is accurate to the extent required by applicable law; and
- Your Content complies with these Terms.
6. Listing Information and Accuracy
All listing information is manually entered by users. RE Microsites does not currently provide or consume MLS or IDX feeds.
You are responsible for the accuracy, completeness, legality, and timeliness of all listing information.
This includes, without limitation:
- Price;
- Availability;
- Address;
- Square footage;
- Lot size;
- Bedrooms and bathrooms;
- Property type;
- Listing status;
- Year built;
- Property features;
- Descriptions; and
- Any other marketing claims.
You are responsible for updating or taking offline a microsite when the information is no longer accurate or the property is no longer being actively marketed.
7. AI-Assisted Content
The Service may provide AI-assisted generation of listing headlines, bullet points, and property descriptions.
For these features, RE Microsites may transmit property listing information to third-party AI service providers, including OpenRouter and models provided through OpenRouter by providers such as Google and Anthropic.
Information submitted for AI generation may include:
- Property address;
- Price;
- Bedrooms and bathrooms;
- Square footage;
- Lot size;
- Year built;
- Property type;
- Listing status; and
- Your manually entered property description.
Lead information is not intentionally submitted to AI providers for listing-content generation.
AI-generated content may be inaccurate, incomplete, misleading, inappropriate, or unsuitable for your intended use.
You are responsible for reviewing, editing, and approving all AI-generated content before publication.
RE Microsites does not guarantee the accuracy, legality, fair-housing compliance, or suitability of AI-generated content.
8. Buyer Leads
Public microsites may allow prospective buyers or other visitors to submit their:
- Name;
- Email address;
- Telephone number; and
- Message or inquiry.
Lead information is made available to you in the RE Microsites dashboard and may also be sent to you through transactional email.
You are responsible for how you use lead information after receiving it.
You agree to comply with applicable privacy, consumer-protection, email, solicitation, and real-estate laws when contacting or otherwise using lead information.
You may not use lead information for unlawful spam, harassment, discrimination, fraud, or unrelated purposes.
9. Acceptable Use
You may not use the Service to:
- Violate any law or regulation;
- Publish fraudulent, deceptive, false, or misleading listings;
- Advertise property without proper authorization;
- Publish unlawful discriminatory content;
- Infringe copyright, trademark, privacy, publicity, or other rights;
- Upload malicious software or code;
- Attempt unauthorized access to accounts, systems, or infrastructure;
- Circumvent security or access controls;
- Scrape or automate access in a manner that materially burdens the Service;
- Interfere with Service availability;
- Send unlawful spam or abusive communications;
- Collect personal information unlawfully;
- Impersonate another person or organization;
- Abuse infrastructure or consume excessive resources in a way that materially affects other users; or
- Use the Service for fraudulent or illegal activity.
10. Subscriptions, Billing, and Payment
The Service is offered through paid monthly subscription plans.
Current commercial plans may include pricing of $39, $69, and $129 per month, depending on the selected plan and features.
Prices may change from time to time.
Payments are processed through Stripe.
By purchasing a subscription, you authorize Stripe and RE Microsites to charge your selected payment method for recurring monthly subscription fees and applicable taxes.
Subscriptions automatically renew each month until canceled.
The temporary 90-day beta free period is a limited beta program and is not part of the permanent commercial offering. Separately from your subscription, domain registrations beyond your plan's included allowance are paid for at checkout at the time of registration and are not part of your recurring subscription charge.
11. Cancellation and Refunds
You may cancel your subscription at any time.
Cancellation prevents future renewal charges but does not entitle you to a refund, credit, or prorated reimbursement for amounts already paid, except where required by law.
All fees are non-refundable and non-creditable. This includes domain-registration charges: overage amounts for domains beyond your plan's included allowance (or above its included cost threshold) are calculated at checkout, charged immediately to your card on file before the registration is submitted, and are non-refundable once submitted to the registrar.
Cancellation does not automatically delete your account, site content, photos, leads, or other stored data.
12. Failed Payments
If a recurring payment fails, your account may enter a past-due state.
We may:
- Send billing or dunning notices;
- Allow Stripe to perform automatic retry attempts; and
- Continue hosting your sites during the applicable retry period.
If payment remains unsuccessful after the applicable retry process, we may pause your account and place your published microsites into a neutral unavailable state.
Data is not automatically deleted because of failed payment.
13. Domains You Bring to the Service
You may connect a domain you already own.
For customer-owned domains:
- You remain responsible for registration, renewal, and ownership;
- You may be required to configure DNS records;
- RE Microsites does not modify your MX records;
- Cancellation or termination results in the domain being disconnected from the Service; and
- RE Microsites does not take ownership of or otherwise modify the domain beyond changes necessary to provide the Service.
14. Domains Registered Through RE Microsites
RE Microsites may register domains for customers through our registrar account with name.com. For new registrations, you are the registrant of record and the owner of the domain. We act as your domain-management service provider: the domain is registered using your registrant contact information, and we continue to manage DNS, renewal, and provisioning on your behalf through our registrar relationship.
For domains registered through us:
- You are the registrant of record and retain ownership of the domain;
- Registration uses the registrant contact information you provide, which must be accurate;
- You may request transfer of the domain to your own registrar at any time by emailing hello@remicrosites.com;
- Transfers are handled manually and remain subject to registrar, registry, and ICANN requirements, including the initial 60-day transfer lock that applies after registration or a prior change of registrant;
- If a domain is temporarily ineligible for transfer because of a registrar or registry lock, we will tell you and unlock it as soon as restrictions allow; and
- If your service ends and no transfer is requested, auto-renewal will be disabled unless you ask us otherwise, and the domain remains registered in your name until it expires or you transfer it.
Domains registered before August 24, 2026 may have been registered under our contact information as part of earlier registration handling; contact us to update registrant details on such domains.
Domain availability is not guaranteed.
Transfers may also be subject to registrar, registry, ICANN, anti-fraud, lock-period, or other third-party requirements beyond our control.
15. Third-Party Services
The Service relies on third-party providers, including:
- Clerk for authentication;
- Stripe for payment processing;
- Cloudflare for DNS infrastructure, R2 object storage, and email routing for our support mailbox;
- name.com for domain registration and DNS hosting;
- Resend for transactional email;
- Microsoft 365 for the RE Microsites support mailbox;
- OpenRouter and underlying model providers for AI-assisted listing content; and
- Hetzner for application hosting infrastructure.
Third-party services are governed by their own terms, policies, availability, and security practices.
We are not responsible for failures, changes, outages, or acts of third-party providers that are outside our reasonable control.
16. Intellectual Property
The Service, including its software, interface, templates, code, designs, documentation, functionality, and RE Microsites branding, is owned by Athencia LLC or its licensors and is protected by intellectual-property laws.
Except for the limited right to use the Service under these Terms, no ownership rights are transferred to you.
You may not:
- Copy or redistribute our software;
- Reverse engineer the Service except where such restriction is prohibited by law;
- Extract or reproduce proprietary source code;
- Remove proprietary notices;
- Use RE Microsites trademarks without permission;
- Resell or sublicense the Service without authorization; or
- Use unauthorized access to our systems, software, or proprietary materials to develop a competing product.
17. Account Termination and Data Retention
Cancellation, nonpayment, suspension, or account termination does not automatically delete your data.
When an account is canceled or paused after unsuccessful payment retries:
- Published microsites are placed into a neutral unavailable state;
- Account data is retained;
- Property records and site content are retained;
- Uploaded photos and headshots are retained;
- Buyer lead information is retained;
- Customer-owned domains are disconnected but otherwise left unchanged; and
- Domains registered through RE Microsites remain registered until transferred or allowed to expire.
Deletion occurs only after a verified deletion request from the account holder.
You may request deletion by emailing hello@remicrosites.com.
We will complete verified deletion requests within 30 days.
Deletion includes the account profile, properties, site content, uploaded photos and media, and lead-capture personal information such as names, email addresses, and telephone numbers.
We may retain anonymized or non-personal aggregate information.
We maintain encrypted off-site backups using a retention schedule of 7 daily backups, 4 weekly backups, and 6 monthly backups.
Backups are not individually modified when a deletion request is completed. Residual copies may therefore remain in backup systems until they age out naturally, generally within approximately seven months after deletion from active systems.
Third-party providers may retain information independently under their own policies and legal obligations.
18. Suspension and Termination by RE Microsites
We may suspend, restrict, or terminate your access if we reasonably determine that:
- You violated these Terms;
- Your activity is illegal or fraudulent;
- Your account presents a security risk;
- Required payments remain unpaid after applicable retry or dunning processes;
- Your usage creates excessive resource consumption or materially disrupts the Service; or
- Suspension or termination is reasonably necessary to protect RE Microsites, users, third parties, or our infrastructure.
Where reasonably practicable, we will provide notice.
19. Service Availability
We aim to provide reliable service, but we do not guarantee uninterrupted or error-free availability.
Service availability may be affected by:
- Infrastructure maintenance;
- Hetzner outages;
- Cloudflare outages;
- Registrar or DNS failures;
- Third-party service failures;
- Security incidents;
- Internet failures;
- Software defects; or
- Other circumstances outside our reasonable control.
We may modify or discontinue all or part of the Service subject to applicable law and contractual obligations.
20. No Guarantee of Results
RE Microsites does not guarantee:
- Website traffic;
- Lead volume;
- Search-engine ranking;
- Property inquiries;
- Property sales;
- Marketing performance;
- Domain availability; or
- Any particular financial or business outcome.
21. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Nothing in this section excludes warranties that cannot legally be excluded.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHENCIA LLC, RE MICROSITES, AND THEIR OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST BUSINESS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO RE MICROSITES DURING THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- $100.
Some jurisdictions do not permit certain exclusions or limitations, so some provisions may not apply to you.
23. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Athencia LLC, RE Microsites, and their owners, affiliates, employees, contractors, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from:
- Your Content;
- Your listings or advertising;
- Your use of lead information;
- Your use of the Service;
- Your violation of these Terms;
- Your violation of law;
- Your violation of fair-housing or anti-discrimination requirements; or
- Your infringement of another person's rights.
24. Copyright Complaints
If you believe material hosted through the Service infringes your copyright, contact:
Your notice should identify the copyrighted work, the allegedly infringing material, your contact information, and any other information required under applicable law.
25. Changes to These Terms
We may update these Terms from time to time.
The updated Terms will include a revised "Last Updated" date.
If a change materially affects your rights, we may provide additional notice where appropriate.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
26. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Service must be brought in the applicable state or federal courts serving Snohomish County, Washington.
You consent to the personal jurisdiction and venue of those courts.
These Terms do not require arbitration.
27. General Terms
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent.
We may assign these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, or similar transaction.
These Terms, together with our Privacy Policy and any applicable order or written service agreement, constitute the agreement governing your use of the Service.
